1. Who we are

This website, www.yamunaexpresswayplot.com (the “Site”, trading as Yamuna ExpressWay Plots), is operated by Brainguru Technologies Private Limited (“Brainguru Technologies”, “we”, “us” or “our”). We decide why and how the personal data described in this policy is processed, so under India’s Digital Personal Data Protection Act, 2023 (the “DPDP Act”) we are the Data Fiduciary for it.

This policy explains what personal data we collect through the Site and through calls, WhatsApp messages and emails about an enquiry, why we use it, who we share it with, how long we keep it and the rights you have. It does not cover other websites, including those we link to.

2. Personal data we collect

Enquiry form: your name, phone number, the type of land you are interested in and anything you write in the message box.
Calls and WhatsApp messages you start with us: your phone number, the name shown on your WhatsApp account and what you tell us about your requirement.
Emails you send us: your email address and the content of your email.
When you visit the Site: your IP address, browser and device type, the pages you visit, the page that referred you, and the date and time. Our hosting servers and content delivery network record this in operating and security logs; Google Analytics and Cloudflare Turnstile also receive some of it (see sections 5 and 6).

We do not ask for Aadhaar, PAN or other government identifiers, bank or card details, passwords, or information about your health, religion or similar sensitive matters. Please do not include such details in the message box.

3. Why we use it

To reply to your enquiry by phone, WhatsApp or email.
To refer you, if you agree, to a seller, broker or professional who may be able to help (see section 4).
To keep a record of enquiries and our replies.
To keep the Site secure and to prevent spam and abuse of the enquiry form.
To understand, in aggregate, how the Site is used so that we can improve it.
To comply with the law and with lawful requests from authorities.

We process enquiry data on the basis of the consent you give when you submit the form or contact us. We process security logs, and data needed to comply with the law, for the legitimate uses the DPDP Act allows. We do not sell personal data and do not use your enquiry for unrelated marketing.

4. Referrals

We do not sell property and are not a party to any sale. Where we can, we put an enquirer in touch with a seller, broker or professional. We share your name, phone number and requirement with them only after you have agreed to that referral, usually during our call or chat. The person we refer you to is independent of us and is responsible for how they use your data under their own terms. If you do not want to be referred, tell us and we will only reply to you ourselves.

5. Who else processes your data

We use these service providers, which process personal data on our behalf to run the Site and handle enquiries:

Amazon Web Services: hosting of the Site and its database in AWS’s Mumbai region, and delivery of pages through its CloudFront network.
Google: Google Workspace, which delivers enquiry emails to us; Google Analytics; and Google Fonts, which serves the Site’s typefaces.
Cloudflare: Turnstile, which checks that a form submission comes from a person and not a bot, and DNS for the Site’s domain.
Meta Platforms (WhatsApp): if you message us on WhatsApp, under WhatsApp’s own terms and privacy policy.

Some of these providers may process data outside India. We may also disclose personal data where the law requires it, and to a successor if the Site or our business is transferred, on terms consistent with this policy.

6. Cookies and similar technologies

Google Analytics 4 sets cookies (named _ga and _ga_ followed by an ID) to count visits and show which pages are used. We use the reports in aggregate only. You can block these cookies in your browser or install Google’s Analytics opt-out browser add-on.
Cloudflare Turnstile reads signals from your browser when you submit the enquiry form, to tell people from bots.
The WhatsApp chat button stores a small note in your browser’s local storage (for example, that you closed its greeting).
Google Fonts: your browser downloads the Site’s fonts from Google’s servers, which receive your IP address.
WordPress sets login cookies only for the Site’s administrators.

You can delete or block cookies and local storage in your browser settings. The Site still works if you do.

7. How long we keep it

Enquiries (form submissions, emails and our notes of calls and WhatsApp messages): until you ask us to delete them, unless the law requires us to keep them longer.
Analytics data: for the retention period set in our Google Analytics account.
Server and security logs: for the limited period our hosting and security providers keep them.

8. Security

We take reasonable security safeguards to protect personal data: the Site is served only over HTTPS, access to enquiry records is limited to the people who handle enquiries, and the form is protected against automated spam. No method of transmission or storage is completely secure. If a personal data breach affects you, we will inform you and the Data Protection Board of India as the law requires.

9. Your rights

Under the DPDP Act you can:

ask for a summary of the personal data we hold about you, what we do with it and who we have shared it with;
ask us to correct, complete or update it;
ask us to erase it;
withdraw your consent at any time. This does not affect what we did before, but we may then be unable to answer your enquiry;
have a grievance about our handling of your data addressed; and
nominate another person to exercise these rights for you if you die or become unable to do so.

To use any of these rights, contact us using the details in section 10. We may need to confirm your identity first, usually by replying to the phone number or email address you used. We will respond within the period the law requires.

If you are not satisfied with our response to a grievance, you may complain to the Data Protection Board of India.

11. Children

The Site is meant for adults. We do not knowingly collect personal data from anyone under 18. If you believe a child has sent us their details, contact us and we will delete them.

12. Changes to this policy

We may update this policy, for example when the law or our service providers change. We will post the new version on this page with a new “Last updated” date.
